TERMS OF USE

These Terms of Use (“Terms”) form a binding agreement between you (“User,” “you,” or “your”) and Move Up Marketing LLC, Move Up Marketing Group, and their owner Linda Jordan, our service providers Twilio and SendGrid (collectively, the “Released Parties,” “we,” “us,” or “our”).
By accessing or using any Move Up Marketing website, digital property, or service—including www.moveupmktg.com (our corporate website) and www.moveupmktggp.com (our marketing and opt-in domain)—you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree, do not use the Site or submit any information.

  1. Modifications

We may update or modify these Terms at any time without prior notice. Continued use of our Site after changes are posted constitutes acceptance of the updated Terms.

  1. Eligibility and Account Responsibility

You represent that you are of legal age and authority to enter into this Agreement. You are solely responsible for maintaining the security of any account credentials. We may suspend or terminate access at our discretion, with or without notice.

  1. Domains and Marketing Purpose
  • Primary Domain: www.moveupmktg.com — corporate information, services, and client relations.
  • Marketing Domain: www.moveupmktggp.com — landing pages used exclusively for email opt-ins, promotions, and marketing communications.

By submitting information on either domain, you agree to receive marketing and promotional communications via email, text, and other channels. You may opt out at any time using the instructions in each message.

  1. Contractual Consent – SMS and Email Marketing

By signing up through moveupmktggp.com, you entered into a marketing agreement with Move Up Marketing LLC, DBA Move Up Marketing Group.
You expressly consented to receive promotional text and email messages in exchange for a 10 % discount on your first marketing campaign or related services. We may even give you more discounts or event invites down the road at our discretion.
This constitutes valid contractual consideration. If you do not wish to be contacted, do not sign up or provide your information.

  1. Limited License and Permitted Use

We grant you a revocable, non-exclusive, non-transferable right to access the Site for lawful personal or business use only. You may not:

  • Use the Site for unlawful or deceptive activity.
  • Attempt to access, copy, or reverse-engineer any portion of our systems.
  • Upload or transmit malware or unauthorized materials.
  • Use Site content to train or develop AI or machine-learning models.
    Violation may result in termination of access and possible legal action.
  1. Intellectual Property

All content, software, designs, and materials on the Site are proprietary to the Released Parties. No ownership rights are transferred to you by accessing or using the Site.

  1. Disclaimer of Warranties

The Site, services, communications, and all related materials are provided “AS IS” and “AS AVAILABLE.”
We make no representations or warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or security.
Your use of the Site and our communications is entirely at your own risk.

  1. Total Waiver of Liability

To the maximum extent permitted by law, the Released Parties are not liable for any claim, loss, injury, damage, delay, or failure of performance arising out of or in connection with:

  • Your use of our websites, emails, or SMS messages;
  • Service interruptions, network failures, or unauthorized access;
  • Acts of third parties or your own actions; or
  • Any circumstance beyond our control, including but not limited to Acts of God, natural disasters, pandemics, electrical or internet outages, cyberattacks, and governmental actions.

You expressly agree that the Released Parties shall not be held liable for any damages of any kind whatsoever, and you hereby release and waive any and all claims against them arising from your use of the Site or participation in our marketing programs.

If you do not agree to this complete release of liability, do not use our website or sign up for any communications.

  1. Indemnification

You agree to defend, indemnify, and hold harmless Move Up Marketing LLC, Move Up Marketing Group, Linda Jordan, our service providers Twilio and SendGrid and their affiliates from and against any and all claims, losses, liabilities, costs, and expenses (including attorneys’ fees) arising from your use of the Site or your breach of these Terms.

  1. Arbitration and Dispute Resolution

Any dispute or claim arising out of these Terms or your use of the Site shall be resolved exclusively by binding arbitration under the Federal Arbitration Act.
All proceedings shall be conducted on an individual basis; no class actions or collective claims are permitted.
The arbitrator’s decision shall be final and binding.
You waive the right to a jury trial and agree that arbitration is your sole remedy.

  1. Governing Law

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict rules. Venue for any judicial proceeding permitted hereunder shall be in Orange County, California.

  1. Force Majeure

The Released Parties shall not be responsible for any delay or failure in performance caused by circumstances beyond their reasonable control, including but not limited to Acts of God, fire, flood, storm, pandemic, labor disputes, supply chain failures, or governmental orders.

  1. Miscellaneous
  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and us.
  • Severability: If any part is found invalid, the remainder remains in effect.
  • No Waiver: Failure to enforce any provision does not constitute a waiver.
  • Assignment: You may not assign your rights; we may assign ours freely.
  • Independent Relationship: Nothing herein creates a partnership, employment, or agency relationship.
  • Third-Party Beneficiary: Linda Jordan is an intended third-party beneficiary of these Terms with full enforcement rights.
